Eviction questions, Texas
So, I am proceeding with my first eviction and I have a few questions. We rented the house to the wife. Her husband was listed as an occupant, but is not on the lease as a lessee. He has since moved out several months ago, and they are divorcing. I have no contact information for him. Should I list him on the complaint? I did not list him on the 3 day pay or quit, as he is no longer residing there.
Second, is it generally allowed to add other damages to the proceedings? There is no place to list them on the complaint, but she owes me for repairs to damage caused by her son.

Have you downloaded Texas landlord tenant laws.. if not do that.
I would put her name down, as she was only legal occupant.. you could list "Et al "meaning any other occupant, others as your not for certain husband is gone.
et al. n. abbreviation for the Latin phrase et alii meaning "and others." This is commonly used in shortening the name of a case, as in "Pat Murgatroyd v. Sally Sherman, et al." As far as damages once she is out, then from security deposit you would take damages, rent owed, court costs, ect.. and you may have to file another small claims court action to get that money if the amount exceeds her deposit. |
