Listing a "3B" as a "4B"

I looked at a house today I may make an offer on for a buy and hold SFR. The house is listed as a 3 bed 1.5 bath 1300 sq feet. However it has a somewhat finished basement with another full bathroom and about another 800 sq feet of living space including a separate room that could be used as a bedroom. This can not be listed in the sales information because the ceiling height is too low (around 6.5') If I were to buy this house could I list it as a 4 bed 2.5 bath rental? Are there any rules governing the listing specs on rentals?

@Amy A. , The legal requirements for a bedroom are 7' or more ceiling height, 2 methods of egress, and at least 70 sq ft.
