Smoking Tenant

I recently purchased a duplex, a inherited a tenant. In his current lease it stats that he is not allowed to smoke in the building. But during my inspection and walking of the place prior to close I can smell the strong odor of cigarettes and have seen the ashtray in his apartment.  His lease is a month to month lease, and the first month he will be signing a lease of mine is next month. Is there anything I can do to either remove the tenant or enforce the nonsmoking?

Why are you renewing his lease if you want him out?
