Heres my situation,

Just bought a Triplex, I live on the 2nd floor, and I have a problem tenant on the 3rd floor which I inherited.

-They are 2 months behind on rent

-History of falling behind on rent

-Mom who has a disability, 10 year old son, and boyfriend who doesn't work

-Just bought two weeks ago, technically they have not signed new leases

-I live in MA, and its owner occupied. is there a chance i can get them out or am I stuck?

Ryan, although I do business in MA, I don't have rentals in MA, only NH, so I don't pay as much attention to the MA eviction process as I do to other MA laws.  I do, however, have some resources to give you.  I can refer you to 3 good attorneys and you should also connect with Dave Fleckner in Fitchburg, he knows the process inside out.  Even though Dave knows the process well, it is different since you are owner occupying.  Do not try to do this on your own in MA without an attorney, it will end up costing you far more than it would have if you screw it up and the judge makes you start all over.  PM and I'll send you the three attorneys and you can make your own decision as to which one.  don't try to DIY this.
