have a tenant in NY that is always paying late "checks in the mail" BS every month. Served her the 3 day notice to pay on July 7th. Her response to process server "I'm not worried about this". No call to me advising when/if she was going to pay. So tonight she got served petition and notice if petition for eviction due to nonpayment. Of course no she calls, I have nothing to say to her to I didn't answer. MY QUESTION, if she shows up a court with full pae t do I have to accept it? I just want her gone she's a head ache. Or better yet can i take payment and still be awarded warrant of eviction?
