Tenant not present at eviction hearing.

I’m on my way to court shortly to evict a tenant. She text and said she is at work and not coming. Is this an automatic win? I’m in Memphis, TN. I was hoping to get a date to move her out. Would that happen without her being present?

No.  You still have to present evidence showing why she is being evicted. She does not need to be present.  If you get possession, ask the judge at the end of the hearing what the next steps are.


 Update: Everything went in my favor including the judgement and court cost. It was a WIN for me.
