No.  You still have to present evidence showing why she is being evicted. She does not need to be present.  If you get possession, ask the judge at the end of the hearing what the next steps are.


 Update: Everything went in my favor including the judgement and court cost. It was a WIN for me.

 Ding Ding Ding, you were right! Everything went just as you said. 

I’m on my way to court shortly to evict a tenant. She text and said she is at work and not coming. Is this an automatic win? I’m in Memphis, TN. I was hoping to get a date to move her out. Would that happen without her being present?

Congrats on your purchase, Will you use property managers any? What drove you towards purchasing duplexes?

I was looking for passive income and the property was newly renovated so it seem easier to acquire with little to no work needed for tenants to move in immediately.

Not that verbatim but something along those lines. The goal is to set a standard without having to go to court but if you have to do that it is what it is. Of course late payers aren't ideal but that's why they're renters and not owners, it's going to happen in the business but if there's no communication then that's concerning. If no communication is made by the 15th I'd get an attorney to file to evict.

Read up on that, understand it, and then start taking action. If you don't feel comfortable, hire them to handle it for you.

I would post notice and start the eviction process. However, they may have stopped talking to you because they abandoned the unit and moved away. It's important to visit the property and verify whether they even live there any more. Take someone with you for safety and as a witness. Talk to the neighbors, observe from outside, peek in the windows, beat on the door, enter the unit, or whatever. It's quite common that tenants will stop paying rent and communicating because they've packed up and left without telling you.

 Hi @Nathan Gesner. Thank you so much for your constructive criticism. You are absolutely right. I guess I was naive when I met the tenants and they both seem to be good people. I didn't think anything would NOT ever happen, just no this fast. I will be reading up on the link you sent me and also calling the attorney for further consultation. I did go by the unit and there was a car parked outside along with a light on in the home. I was planning to go by today with a friend to see if we can make contact. And again thanks for your input, some people ridicule without educating so at the very least I am able to learn from this sting and move forward in confidence. 

I bought a duplex a month ago and inherited a tenant on each side. One tenant has paid the rent on time but one tenant is missing in action, unresponsive to phone calls and won't pay. Today is the 7th and still no sign of said tenant. What is the first step I need to take to stand firm on receiving payment? I don't want to handle the first occurrence ineffectively and overall send the wrong message. I am new to being a landlord and want to familiarize myself with TN laws. What sites should I read up on? Should I immediately get an attorney? What steps should I take at this point to ensure I am going about this the right way. Any and all help is appreciated.
