Illinois resident selling property in Georgia- tax withholding

Hi, I am the process of selling property in GA. Closing attorney sent me affidavit of exemption from withholding form to fill. For Non residents there will be 3% withholding of the gain on the sale. If I am going to file return end of the year do I need to withholding 3% now?
