Possible subto with a deceased borrower on loan. Can this be done?

Pre foreclosure lead in Orlando. Original owner passed away about 3 yrs ago. Daughter now lives on property. Currently has an open case w/bank. Siblings have passed away and based on what she told me there is just one niece that she has not spoken to. No will left (intestate)  Unpaid principal balance at 63k. total payoff amount 85k. mortgage payments believed to be about 800 per month. 

I would like to do a subject to and take over payments but i dont know how much of a factor it will be if the person on the loan has passed away. Would this be an issue? Property has not gone through probate yet as well.

I would love to hear what everyone thinks on this situation.

Subject-to with a deceased borrower and non-paying occupant... for a first investment property? There have to be better candidates.
