Legal Concerns with Marketing

Is their a good resource for the best practices to protect myself from any legal issues relating to marketing. For example i am looking into cold calling, RVM, SMS, & postcards and i have seen/heard stories of people being sued using some of these methods. I am in the Atlanta, Georgia area and i am wondering who has experience with this market? Do i have to make sure i sign up for these online marketing sources using my LLC so if i am sued it wont be me personally it will be my LLC?



Any advice here would be valuable...

Hi @Jef A. I can generally speak to texting and compliance. There are two things to consider when it comes to cold texting. 

1. You will need to be making an offer to purchase something from the person you are texting. This is the only way to be compliant with cold texting. 

2. You can't use an auto-dialer. You have to use a system where it's one click to send one message. You can request a legal opinion letter from any texting company you decide to use. If they are operating compliantly they should be able to produce one.

If you are texting manually, you can use this as a loose guide.
