Buying with Tenants! Need help!!

Hello BP

Hoping I can get some help, long story short

I have a duplex under contract for FHA Owner occupy, both units currently rented out. My problem is the contract stated that one unit should be vacated on or before closing, and closing was originally 5/1..

Here it is a month later and my agent tells me that the tenant hasn’t moved, and an eviction hasn’t been served and that she’ll sign a paper saying she’ll be out in 30 days, which I don’t believe.

I don’t know if I should close with the tenant still there, or delay my closing until the tenant is evicted; is it possible to delay closing this long?

Any help is appreciated!
