weird shortsale situation - need advice

I found a house that is in foreclosure, I contacted the owner and he told me is divorced and he wants to sell the house, but his ex wife doesnt want to sell the house.  (he moved out, she is living there)

the deed is in both their names

the mortgage (1st mortgage) that is being foreclosed is only in his name somehow

he just wants out, can we do a short sale?

does she have to be on board also?

can i buy just his share? (or is that a stupid move)

I am a new investor, any advice is appreciated.

This is a dead end. The property is upside down, you have more than one owner to deal with, and they have different motives.
