Can a Listing Agent buy their own REO listing?

Or does this create a conflict of interest? Would this be state specific (I'm in Texas) or lender specific? Im not a real estate agent but my business partner is, and we are considering going after REO listings as a possible inside track on good lead for rehabs.

I am an REO broker and it is a conflict of Interest to buy your own listings. In fact many banks prohibit an reo broker from buying any properties from certain banks. HUD, Bank of America and a few others prohibit a listing broker for them from buying any REO listed by that company. B of A prohibits their brokers from buying b of a short sales! I actually stopped listing for them because of that.

I will add that it is not easy to get into reo. If you guys want some more info, let me know.
