Properties that are titled in a deceased persons name

Hi guys. I have several motivated sellers that are heirs to properties that they have not probated and are still in the deceased's name. Can I purchase a property or put a property under contract that is in the name of a dead person or do I try to convince the heirs to probate the will?

@Dar Rose If I am understanding you correctly, yes you can assuming there is an executor appointed as well. On the TREC 1-4 contract paragraph 1, parties in the transaction, for the seller put estate of (insert deceased persons name here).
