Broken AC discovered after closing

I closed on a house today (yay 🙂) but I have discovered there might be a problem with one of the two AC units. I couldn’t get it to turn on, and it’s pretty old (16 years). The seller marked that it was working in the seller’s disclosure notice.

To get the deal, I had to remove my option period (inspection contingency), and I budgeted a new AC into my numbers.

But since the seller said it was working as part of the disclosure, do I have any recourse if it’s indeed broken?

Lesson learned - NEVER waive the inspection id you don't inspect.  It doesn't take that long to look at mechanicals on a building.

As far as disclosure, about the only way you could show fraud/misrepresentation is if you found an inspector / repair guy that looked at that particular house and was willing to say he told the seller the A/C was dead.

Of course, by the time you get lawyers in it, is it worth it?

Chalk it up to tuition.
