NJ seller and seller agent didn't disclose soil contamination

Recently we went through home inspection for a house in NJ the home have a active UST, when the company came to test the soil for contamination it found that there were previous bores in the ground, it was apparent that a prior test was done. New sample was taken and found to be contaminated, when my Realtor inquired from listing agent about the contamination she apologize and stated that she didn't know but her partner knew about contamination and she have some quotes with clean up. We are furious that we spent $1000 plus the lawyer fees, we feel taken advantage off.

My question is there anything I can do get my money back. The house is short sale more likely the owner will not pay. There was no mention of contamination in the seller disclosure nor anywhere in the contract either. What should be our course of action. Any help is greatly appreciated.
