What are the legalities to giving a real estate agent a referral fee?

Situation: Let's say another investor locks up a deal for a rediculously low about through direct marketing. The agent just puts it on the MLS to work it through the short sale process. If I were to convince the investor to assign the deal would the agent be able to collect a referral fee ($1500) on top of commissions if it closes? Is this something I can write up in the contract?
