Denver, CO - SFH - Seller Disclosure Requirements

I recently ran into an issue where I made an offer on a property in Green Valley Ranch in Denver, Colorado and didn't find out until after my offer was accepted, inspection complete and almost went to closing that the house was actually part of the Affordable Housing Program. No one told me. Not my realtor, not their realtor, not the title company. No one. I only happened to find out in my own due diligence.

When I confronted both realtors they seemed offended that I was offended that no one told me the house was in the Affordable Housing Program (AFP). Being part of AFP puts many restrictions on resale value, rental options, etc. Seeing as I was purchasing it as a rental property you can see why it would be a very big deal to me that this information wasn't disclosed.

My questions is this: are realtors required to disclose when a house is part of the Affordable Housing Program? Can I get my earnest money and inspection money back? Any legal experts out there that can offer input?

Is anyone familiar with this area of Denver or have any experience in a similar situation??

This issue has been in the news lately as many people fell into the same deal and didn't know until they tried to sell their home. 

Can you even rent it if it's in the program?

I'd start a paper trail with your agent and cc their managing broker. Then bring in an attorney if you need to. Also, this site ranks well on google. A quick search of your name will probably bring up this post. When it comes to a lawsuit, it's best not to have info floating out on the web.
