Buying with option to purchase agreement.

What would be the biggest issues with an investor trying to use an option to purchase contract on a home that just became a pre-foreclosure? Let's say due diligence has been done and discovered the house has just enough equity in it to make a deal. The buyer wants to tie the house up with an option to purchase contract and sell the house for retail price all before the house make it to auction.
