4plex zoning issue on appraisal

Hi everyone! I have a fourplex that I am selling in Indianapolis and just got an email from the buyer's agent that property may not be legally zoned for a 4unit. In the email that the buyer's agent forwarded, the appraiser stated that the side yard was not legally wide enough to qualify the structure for D8 zoning and that using the building as a 4unit may be illegal. When I bought the property, that appraiser wrote in his description that the property was legally zoned D8. Now my seller is asking for a variance, which I don't have, and the deal might fall apart. Any thoughts or suggestions?
