I called the city today and they said that while the home is zoned for D8 (residential multifamily) it was originally built as a Duplex and the current footprint is not zoned for a four unit. They said that if there was a variance on record for when the conversion took place, I'd be fine. Of course, there's no variance. I was told that in order to get the variance I'd have to apply for it and hope it gets approved, 8-10 weeks.

The thing that really bothers me is that it is appropriately zoned but if the building burns down, it can only be built as a duplex or smaller. How did this not get caught when I originally purchased the property?

Hi everyone! I have a fourplex that I am selling in Indianapolis and just got an email from the buyer's agent that property may not be legally zoned for a 4unit. In the email that the buyer's agent forwarded, the appraiser stated that the side yard was not legally wide enough to qualify the structure for D8 zoning and that using the building as a 4unit may be illegal. When I bought the property, that appraiser wrote in his description that the property was legally zoned D8. Now my seller is asking for a variance, which I don't have, and the deal might fall apart. Any thoughts or suggestions?
