What is really about passive invest or passive investor legally?

Right now,I am just about to begin to my real estate investor.

I am H1B working visa who have a full-time job in financial industry.After search tons of the threads,I have the questions regarding the legal issue for my investing.

As far as I know,if I invest real estate as H1B holder,I have to be passive investor,it should not be business,because H1B is limited to sponsored employer.

So,legally,what is really passive invest as it comes to real estate investing?How can I prove I just passively invest in real estate not running business?

I believe LLC is not choice for me,so I need use insurance for asset protection.For operation part,I will hire project manager for rehab and property manger for management. Anything else should I be careful?

From tax perspective, I would like to employ as aggressive tax as I can,according to the tax books I read,it seems that I should deduct any expenses which contribute to invest,but if I really do that,is it means that I am actively involved in the business?

I really want to start my real estate investing now and since my Green Card application is not start yet,so I will be H1B holder for at least 5~6 years,I would like to scale my investing in this 5~6 years,without violate  the H1B related laws and risk my Green Card application.

Any suggestions and real stories are welcome,thank you so much!
