Seller want to raise the purchase price. Can they?
I am/was under contract on a property in NJ and now the seller wants to raise the price. I guess we are technically out of contract because I haven't provided them a mortgage conformation by the deadline in our contract but that is because I needed the CO from the seller and they have not provided one. They just had a chimney cert to get the CO and found out they need 2 new flues. This I guess is the reason they want to raise the price but can they do that?

Yes. If you are out of contract that agreement has expired and you must negotiate a new one. Nothing in the old agreement need carry over to any new one.
