Some realtors out there are just plain shady!!

I submitted an offer on a duplex thats listed for 339k for 350k. The realtor emailed me back saying they have offers above that. I said ok i will be sending an offer over for 365k and he wrote back saying.... Well we are currently working with an offer thats 5k less than your 365k and its a conventional loan. (This whole conversation happened in a 10 minute block by the way). what confused me was my offer was cash and I could only assume that he must have had both sides of the deal on the conventional offer that his seller received smn. Anyone else encounter this problem?

There is also the possibility it is the seller. Could be anything and the realtor has a duty to the seller, not the person placing the offer.

Maybe the seller saw the name "Mary" on a contract and it reminded him of his daughter. Maybe the seller was excited to the finaincing was going through 'Midwest Federal" and his old golf buddy worked there and he was looking to catch up on a round. Perhaps an offer was put in by his cousins, boyfriends sisters former roomate and he said "Bah I want that one lets see if they can come through, I am in no hurry". Perhaps he had a friend who dealt with the investor before and said "I don't care what happens I will never sell anything to (insert investor name) or anything through (insert other realtor here)".

The realtor passing any of that information on to someone placing an offer is not in the best interest of his/her client. Yes they have to present your offer to the seller, unless the seller said I don't want to be bothered with any more offers or any offers from (insert name). That realtor has to perform their duty confidentiality is part of that. Just saying there could be other reasons beside a shoddy realtor. People buy and sell for a whole lot of reasons and it isn't always the most money, quickest close or least contingencies. For those of us who look at property in pure dollars and cents period. It is hard to understand why in the world a person would take a worse offer or hold on to something for financing when they could get cash in 10 days, but it happens.

I would debate that telling someone who was putting in an offer why could be a breach
