New owner being sued for old tax lien on a property that was just purchased? (Re: Podcast 88)

Hopefully Matt or Liz can chime in on this to give some insight. While listening to Podcast 88 Matt mentioned that he was sued by a tax lien holder for a property that he just purchased. It kind of worried me because I always thought that this stuff would be caught with a title search and would have to be cleared up before transferring the property? Even if it weren't caught wouldn't title insurance, assuming it was purchased, have to pay to clear up anything like that, that was missed?
