Big void under foundation - Dirt missing - Purchased from open door

Posted

Hi All, Purchased home in texas last week from opendooor, While doing bathroom remodeling found there is big void or dirt missing under foundation, about 25 ft long, 10 ft width, 4 ft depth. Below link has the video of the void.

When reached out to seller realtor, mentioned that, they have worked with Vendor on filing void under Driveway and said they have no idea about this other big void under the home.

Above Drive way void fillup was not disclosed in SD and bought to our notice only now after closing.

Garage area has big void, which potentially would have collapsed if parked vehicle there. its big risk in my opinion. Am working with foundation companies to fix.

Since seller did not mention about drive way void fix which is also connecting to the other void under home, what will my options in this case. Thsi would have been major consideration with my offer if knew upfront about the issue.

Thank you in advance for your time.

This will be a tough one to go back on the seller as texas is a caveat emptor state. The typical disclosure talks about "known issues". If someone fixes an issue, then it is no longer an issue. For example, if you have a roof leak and fix it, you typically do not disclose the roof had leaks 15 years ago... Unless the specific question on the disclosure is "have you ever"...
