Seller Sadly Passed Away This Week

I'm representing the seller in a real transaction here in Oklahoma. I assisting the buyer as a transactional broker. (AKA I'm helping both sides of the transaction).

Unfortunately, my seller passed away early this week. She was the only person that had title. She died without a will.

Does anyone know the best way to proceed? We were supposed to close next Friday, which now i know will never happen.

Contact the County Administrator or similar officer who will be the adminstrator of the estate. Take a copy of the contract with you, they will need a copy. Hope your contract said, successors, heirs and assigns, since you are an agent using an approved contract you're probably good to go.

The sale will need to be approved by probate. Since it was under contractI would not worry about it, it will be a delay. The Administrator can also act on the contract, so you might ask for possession prior to closing...just pushing your luck, but if you have a good buyer, might happen.

Let the bank/lender know as well as the closing agent. Good luck
