Help me understand who can pay an agent
Hi there, fellow agents.
I was under the impression that the only person who could pay an agent is their employing broker. I thought this was a law, but can't remember if it's CO specific, or maybe I just dreamed the whole thing up...
And yes, I realize that things happen under the table all the time, but in regards to wholesalers or bird dogs, can they legally pay the agent?

I would say I am under the same impression. As I understand it:
1) You hang your license with a broker who is responsible for the actions you take with their name on it.
2) If you are acting as an agent (licensed) you are acting on behalf of who holds your license
3) They receive payment for any actions you perform using your license (because they hold it)
4) They pay you. You cannot be paid by anyone else because they are not holding your license.
So I would agree with you for any actions you use your license for. Now if you were doing something that did not require license (computer programming) then your broker is not allowed to stop you from getting other forms of income because you are an "independent contractor".
