Certificate of Occupancy Requirements- Fort Myers

Does anyone know if a Certificate of Occupancy is required when you have a Triplex with 3 tenants in Fort Myers?  I am looking at a property and the sellers agent says no.  But I called the City and they said yes,  The sellers agent says the woman at the City is wrong.  Help?!
