Foreign investment - LLC needed?

Hi everyone,

Currently living in Canada, I am planning to invest in the US. So far, that's pretty straightforward. I know that if I want to buy properties, I need to do it under a LLC.

At this time, I would like to consider few options:

  1. When doing business in a state, do you have a LLC created in the state, or just having one registered in that state is enough?
  2. Another question is should I do business under a LLC if I do wholesale assignment or double closing?

If you search the forums here you will find several threads about Canadians investing in the U.S.A.   When it comes to deciding on the organisation of your business a lot will depend on your goals; whether you wish to retain the earnings in the U.S.A. or have them repatriated; and your present situation at home (salary, other income).   My advise would be to write down your near term and long term objectives, then find both an accountant and attorney who specialize in cross-boarder real estate and business and pay for a few hours of their time.   They should be able to help you develop an ownership/operational strategy which meets your current needs, but can me evolved to meet your long-term objectives ... while mitigating your taxation.
