Due to that small forest type of tress growing in that area including poison ivy plants (I spent lot of money few months back in clearing that area from all the those poison ivy plants and forest of big old trees grown over the years touching the roof and leaning towards building).

The builder admitted they provided inaccurate information, and they proactively helped the home buyers affected by this issue to get exceptions allowing us to build a fence and plant shrubs on top of and beyond the easement line (but we still can't plant tress). hence, they refused to reimburse us furthermore.

If you do plant tress do not go with a Bradford Pear tree- these are super popular in the Midwest at least and what far too many builders put in and still do as they are very fast growing.
