It could be legit, the seller may have tried to sell and let an option, with the right to seek other buyers, time passing you come in.

Sounds like this is not in your neighborhood, you might get another manager and have them assist you in this matter, they could pick up such files and any lien waivers and take immediate management for you.

I'd put that statute in my lease saying that you retain the right to seek indemnification for any loss or rents or damages under xyz statute.
