This is a double edged sword, if things turn south it can be just as bad.Refinance is best used in growing market, on top of that the tenant is paying off the principal, So even if your cashflow is low you are increasing your equity each time principal is paid

We got a call that day from him saying he has an offer, and he wrote up an agreement with a 3% commission supposedly paid by buyer *yet I have to sign this commission that seller is responsible.

So if the property was worth 100k when it burnt, you got paid 95k from insurance, you might have 5k in loss to report on your taxes, but again to be specific, you'll need to speak with a CPA on the exact details of your situation.
