With no proof either way what are your odds of winning in court? 

It adds up and I do have pics in case the ex-tenant decides to go to court.

@Justin Stewart well lets just say NY is the highest taxed state in the country and FL is near the lowest.

Even then... in every jurisdiction I know of they’d be overstepping the Act if they forced a tenant to pay for it and it would be overturned upon appeal at Appeals court.

However I think his goal of owning some rentals and since he is in OHIO which is one of the better cost to rent ratio areas of the country he is on the right track.. other wise income average into REITS is probably very appropriate for his situation.

One lives in California (he can't find a deal that will cash flow there), another lives in flyover country, where the market is much less expensive.

While you are legally correct, attitudes in the court system, and the particular judge, will determine what happens.
