Don I know the provision you are speaking of concerning if it's the first time they are late in 12 months you have to take the rent.I believe you are mistaken in the fact that you do not have to take personal or business checks.I believe it has to be certified funds.I NEVER EVER take anything but certified funds from my tenants or cash and write a receipt.I do get cashiers checks from charities etc. that I deposit.Actually the tenant is going to be in trouble here.Had she have just left and not replied to an answer from the court you would only get awarded eviction by the judge and had to file the writ.When the tenant in Georgia does not answer the judge can only evict and not issue a judgement.In that case you would have to take her to small claims court.The fact that she has written a bad check that has bounced depending on the amount can be a felony or misdemeanor if she does not cure it.She doesn't sound like a professional tenant to me and you sound like a newer landlord.
