My layman impression is that if both of those points are true, you get contact info on the heirs, update your files, and continue to deposit checks.If they are not paying, the key is to find out who the executor is.

I would put a catch up agreement in writing and have her sign it, but I would file for eviction the second she did not execute on her end of the agreement.

If the target property was owned by an LLC of which your family member was the only member and it did not file it's own tax return, then even though the LLC is on the deed it would be "disregarded" by the IRS.
