The Senate print accompanying the Deficit Reduction Act of 1984 stated that the intent of Congress in amending the statute was to "decrease the controversy and litigation arising under present law with respect to the proper tax treatment of start-up expenditures" by requiring expenses similar to those allowed as deductions in Hoopengarner to be capitalized.

As a broker, I know the contamination will significantly reduce the value of homes in the neighborhood (zero), and I imagine the company will eventually buy the homes actually contaminated...but if I could purchase the property in question at a large discount and rent (w/proper disclosures) at even half the average rental of the neighborhood ($950-$1100)...  

If it is me I'm keeping the tree and putting down pavers with proper drainage underneath, the only exception would be if you have a pet and/ or allow pets in the unit.
