I use Nussbaum LLP  based in NYC for my transactions, but using them is like bringing a cannon to a knife fight for many smaller upstate NY transactions.

Is this unfortunate - absolutely, but I would not recommend spending money on an attorney to try and fight it, especially since it’s not on the property and most likely it’s a public project which the seller would argue it’s also public information.

.#6 That the fair housing rules aren't requiring you to accept an otherwise unqualified tenant just BECAUSE they have an ESA is also not really an exception though it might be viewed as a warning to the careless about denying an ESA.which leaves #3...You're more likely to win on this one in court than you are on a 'financial hardship exception', but as with any legal fight, it's going to cost you some money if there's a complaint (which you'll probably never get back from your likely judgement proof applicant).

If it's scholarships or Mom/Dad, you don't have to worry about credit checks, just do a background check so you know if you have someone with a history of drugs or getting into bar fights wanting to move in.
