I'm worried that if there is no lien and no judgment but there is some on going litigation that I and title company do not know about, that the property could be hit with a lien or be transferred over to the evicted tenant because he wins a case claiming he is the rightfull owner of the property for whatever reason.Maybe unlikely but probably a valid concern right?

Definitely do new leases, even though most states do put the lease as priority over transfer of ownership.  

So towards the end of the year we paid off the HELOC (using balance transfers, then called and asked for a different rate.

The guarantee/warranty transfers to the next owner if you sell the property.

I believe HUD properties are going to come with deed restrictions on them that don't allow you to transfer for a certain price over purchase price within 90 days.
