What I would suggest though is that if he did not give employment notice in writing and if the apt complex did not give notice in writing to vacate, then I don't think they can simply file an eviction.In most areas, a landlord typically has to give the tenant some sort of written notice to vacate and give them a set amount of time to remedy the issue or to vacate.

You should have your client contact an attorney for more specific information, because there are a lot of factors to consider.But in general in California, if the tenant has 1) completely moved out, and 2) has had their lease legally terminated by eviction or vacating upon proper notice...

So if a tenant vacated and trashed the unit (or had to be evicted, or stopped paying rent, etc.), I would have no recourse for that financial hit except a small claims court judgement (which probably isn't worth the paper it's written on).My question is - what would you do?

Once they have vacated their old unit I will then inspect and return their old deposit if there are no damages.I typically only allow transfers for great tenants who I'm pretty certain will leave to find another place anyways if I don't work with them.

It's one thing if they had some believable event happen and they have a solid plan for repayment, but if they keep jerking you around, just give them a 3 day notice to vacate, and tell them you don't want an eviction on your record.Fine better tenants, could this have been screened out?
