Not only must you refund the deposit at the end of the lease, but there is also a lot more administrative work on the back end such as keeping the deposit in a separate interest-baring account and keeping track of that for the life of the lease.

They do their own due diligence, have their own analysts, do their own modeling, create their own PPM, marketing materials, tour the property w/the operator to understand clearly the business plan, making suggestions on strategy, maintain the relationship with the investor base over the entire life cycle of the deal, creating reports, answering questions, managing distributions, K1s, etc.

There is intent but also not really a hard time given you have to hold the property for.Most case law the legal experts feel comfortable at 1 year but people have exchanged with less time before.Look up Exeter 1031 on here and there are numerous others.No legal advice given.

I have bailed out numerous undercapitalized investors that have gotten way over their ski tips drinking the sub too coolaid.. it does not go right and I can tell yo the seller is going to sue you.. and or file a complaint at the AG.
