I'd just add that you should include in your operating agreement a very detailed explanation of how issues are resolved, voting power for all members and who is at the helm of the organization (i'd also spell out roles and responsibilities for each member in a very explicit manner)

Not speaking as an attorney (which I'm not, nor want to be) I personally would certify-return receipt mail his money back, immediately change the locks, and issue a cancellation of lease.If this person pulls this kind of stuff at the get-go, you believe he will change his ways after move in?

The only exception is issues that occur within 30 days of move in, but after 30 days, the tenant owns the problem.
