Hello,I have sold a property in Schaumburg last year on an 'Articles of Agreement for Deed'.The tenant buyer was always late on his payments since we got in this contract and he has not paid last 2 months (Jan-Feb) mortgage yet.I have already sent him a 30 days notice for 'Declaration of Forfeiture' but he failed to bring the account current.

That would be an illegal lease clause and will not hold up in court.

Instead I focused on new probates filed within a week, then also probates the week of their court date for letters.

You may at some point have to go to court to defend your permit if it comes to it.

Keep in mind the TAR lease is for licensed REALTORS to use; it is not for layman and may not stand up in court if you are using a form illegally.I've seen hundreds of different leases over the years and the BiggerPockets version is far better than most.

I might look to modify the court in the future to become a dual pickle ball and basketball court as that might appeal to more families.
