When a state regulatory agency issues a cease and desist order, small investors usually comply, they don't run to court, so case law may be hard to locate, in reality, it may also be a board action which may or not be public.

That being from a law office will or should get attention, to the lender it's much the same as a payoff, give a cc of the letter to the regional bank regulatory authority, it's eye wash, but the question then becomes, "why didn't the bank take the payoff and allow the customer to avoid a foreclosure, damaging their credit further.....for what?"

Those new to notes generally fail to understand what a note is, the classifications, types of interests acquired, the obligations involved, the rights to enforce the contract, what collateral interests are as opposed to ownership rights, the legal rights of borrowers, the exemption rights of a borrower and the regulatory issues between investing with your money and getting into brokerage functions that require compliance.If you look at mortgage/note investing, it's a far cry from RE with respects to the knowledge required.If we were to put notes and RE investing knowledge in an office building, residential RE would be on the ground floor as you enter the building, it goes up to the 4th floor where small multi-family RE begins having their offices across the hall and that goes up to the 6th floor where small commercial properties are dealt with, small office, retail.

Just hearing that JP Morgan has a $13 billion fine $4billion for restitution, BoA is admitting to fraud, SAC losing it's license and forfeits US portfolio and indictments on individuals are coming down as well.Any restitution could take years, better late than never.I guess we will see how hard the executives of the housing bubble get slapped.Anyone hear of anything else on the regulatory front?

We are getting many investors north of the border of the U.S. and I'm clueless of the differences between the two countries as to regulatory issues and laws.It is important to know or have a basic understanding as many issues, such as tenant/management, financing or flipping advice given is often anchored in the underlying regulatory environment.

Then I typically get as a response, "But I figured if I contacted the bank directly, I could cut out the middle man and save us both time and money", and while on the surface that may sound good, any perceived time and money savings is all but gone when I have to spend time and money explaining to my examiners, regulatory agencies, auditors, CRA agencies, Compliance Departments and so many other entities why I sold a home through direct contact and negotiation with a buyer, instead of listing it with an agent and maintaining that "Arms Length" relationship.
