As to any lease, if you don't take possession you may get the landlord to agree to sub-letting by a certain date or avoid the contract, but I wouldn't take any unit off the market unless you covered rents.

Sounds like an encroachment that should have been caught when the house was built, look up adverse possession, you may not be due much if anything.I suggest you take what they give you as it doesn't sound like you have much of a financial loss if your home is far enough away to be marketable, I assume you bought the house with the house next door.

In ky when you foreclose on a property, it goes to a master commissioner's auction and the highest bidder at that auction takes possession and the lien holder is reimbursed through that sale.

Nah, early last year I had 3 out of 4 with felonies for possession with intent to distribute, and the 4th had a misdemeanor for threats to ex-husband and new GF.Remember that they are probably somebody's tenants right now!
