That will fall to the sellers and the negotiation between your agent and the home owners.

Less than three years later, the ceiling and original floor have a noticeable slop and the new homeowners are tearing apart their house to have the loads correctly handled.

Stay away from seller financed notes to consumers (homeowners) if there is not an RMLO license number and seal on the note and Deed of Trsut. 

It's vacant, homeowner probably does not have the capacity or desire to fix/rent it. and would like to wash their hands of it for the amount of the loans.  

Does the HOA have a fiduciary duty to protect emails sent to them from homeowners ?

Selling to a homeowner, you also need to check on Dodd-Frank if this is not your primary residence.
