I also mentioned that the listing agent said cash only and inquired if that meant that we literally have to have cash or of they would entertain financed offers without a "finance contingency" meaning we would forfeit earnest money if financing fell through.

IOTH, you can obtain a quick claim deed for the amount owing, then the equity may be available to you, to do this you must be working with the borrower.Stale notes and lost borrowers can have unique problems.

I just take a more business like approach, IMO, that being taking on any partner is pretty much like taking on an employee, they need to carry thier own water, I'm not paying for something that is not beneficial and I'm not paying more than they are really worth or more than I can obtain from other sources.
