It just causes problems.So, I would find out if the fence is exactly on the property line - if it is on their side then its their fence - but for the matter at hand I would just talk to your neighbor and apologize and then agree to letting the handyperson in to do what he needs to done.

He then apologized for the massive delay of time and no contact and said I would be absolutely right to be upset and if this went to small claims I would definitely win. 

The bigger pockets I know/knew wasn’t so negative and I apologize for the shade they’re throwing your way.
