I actually had a seller financing deal recently fall through and was not charged, but I bet if that was my first creative deal with them they would have charged me for the hours burned (and it also fell through rather early in the process so was not a huge time-suck). 

I wouldn't bet the farm on winning this one in court.

So my question is should I bet on this property bringing in at least 4400 a month consistently going forward to get those 12% returns?

I bet it’s worth even more now, I know the exact house, and it’s on that historic street/sidewalk  right?

Since there's equity, I bet that the owner is going to fight and that his attorney will do everything he can to stall the confirmation of sale.When the confirmation looks imminent, the borrower may file BK on you and drag it out even further.

Having a trust is the best bet as you can put the membership interest in the trust's name and avoid probate.

If you find a great deal and offer to do the PM for it manage it then I bet I’d be pretty easy to find a partner to bring part or most of the down payment.
