It's possible you could bring other charges with the state real estate commission but I don't see ethics being one of them.At least that is how it works in my state of Georgia.When you agree to be a REALTOR and join NAR you agree to their Code of Ethics and agree to any sanctioning based on an Ethics violation or otherwise.I think the key will be how long this tenant has been paying the 50 dollars.If it is just one month and they claim an oversight in getting to you the funds then that is possible.If however this undisclosed rent has been "open and notorious" for many months that shows willful intent and non-disclosure by the PM company and I think you would have a stronger case.This is not legal advice and I am not an attorney just thinking out loud.

I would be concerned about the slope of the line to the street when they replaced it.If the slope isn't right or they have funky bends in it to go around big roots or above them that's when water and debris can sit and cause constant clogs.About every 3 to 6 months the plumber then has to come out and scope the clean out outside to unblock.If material is with dirt etc. is back up in the toilets or they slow drain or make a gurgling noise with bubbles you could have an issue.Make sure as mentioned before buying you get a plumber to scope it out all the way from the toilets to the main and the street to make sure there is not any issues with slopes or clogs.I have heard many horror stories where a buyer calls the county or city and they say on the phone that everything is fine and after they buy it they get hit with all these costs,fines,etc.If they won't give you something in writing I wouldn't feel comfortable about it but that's just me.So this was an existing line to the street and not a sewer tank that they converted later and hooked to the city or county correct??

In other words, if the property has a mortgage and the property is sold to another person without the mortgage being satisfied, the sale can be nullified since the mortgage is superior to the sale.Typically when you purchase a mortgage/dot you will check title but that is mainly to look at future title events post the recording of the mortgage.Hazard Insurance or alike (flood, wind, etc) is updated to reflect the new mortgagee or the owner of the asset.
